The Effectiveness of The Implementation of Supreme Court Regulations and Circular Letters on Divorce and Child Support at The Cibinong Religious Court Class IA

This study aims to analyze the implementation of Supreme Court Regulations (PERMA) and Supreme Court Circular Letters (SEMA) in divorce and child support cases at the Cibinong Religious Court Class IA, particularly concerning the protection of women’s and children’s rights after divorce. This research employed an empirical legal method with a juridical-sociological approach. Data were obtained through document analysis of divorce decisions from 2008–2025, literature studies, and interviews with judges of the Cibinong Religious Court Class IA. The data were analyzed qualitatively using Soerjono Soekanto’s theory of legal effectiveness and Lawrence M. Friedman’s legal system theory. The findings indicate that the issuance of PERMA and SEMA has transformed the practice of religious courts from a formalistic approach toward substantive justice. Judges have increasingly exercised ex officio authority to determine iddah maintenance, mut’ah, madliyah maintenance, and child support even when such claims were not explicitly requested in the lawsuit. The study also finds that the implementation of mediation, the standardization of child support, and the withholding of divorce certificates function as mechanisms to protect women’s and children’s rights after divorce. However, the effectiveness of these regulations still faces obstacles, including formalistic legal culture, low legal awareness, limited gender sensitivity, and weak enforcement and execution of post-divorce maintenance decisions.
