Abstract

This study aims to analyse the application of the fiqh principle of al-masyaqqah tajlibu al-taysīr in addressing issues of taharah (ritual purity) among Muslims who experience aquaphobia, an excessive fear of water, and hydrophobia, a neurological disorder that occurs in the advanced stages of rabies. Based on global epidemiological data, aquaphobia affects 2–4.3% of the world's population, while hydrophobia occurs in 20–50% of the 59,000 annual rabies cases across more than 150 countries. This study employs a qualitative research approach combining normative and empirical methods to establish the legal ruling on taharah. The references for this research include the books Al-Waji ̅z, Al-Majmūʿ, and Al-Mughnī. The research findings indicate that difficulties causing physical or mental harm can serve as a valid basis for performing tayamum even when water is available. The Maliki and Hanbali schools of thought grant a dispensation to individuals with aquaphobia and hydrophobia to perform tayamum, while the Shafi'i and Hanafi schools require taḥqīq al-manāṭ, with the condition that medical criteria, particularly for severe aquaphobia, are met for continuous tayamum, provided it is based on professional diagnosis and there are no immediate alternative treatments.
